1. Acceptance of Terms

By accessing or using Favorites.app ("Favorites," "the Service"), operated by Rhett Melton, you agree to be bound by these Terms and Conditions ("Terms"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Favorites is a platform that allows you to save, rank, organize, and share your favorite media across categories including written works, spoken content, music, video, images, and interactive media. The Service includes features such as:

• Item saving and metadata enrichment from third-party sources
• Elo-based comparative ranking
• Curated lists and public profiles
• AI-powered recommendations and content generation
• Social features including following, groups, and comments
• SMS-to-inbox functionality

3. Accounts

3.1 Registration

You must create an account to use the Service. You agree to provide accurate and complete information and to keep your account credentials secure.

3.2 Eligibility

You must be at least 13 years old to use the Service. By creating an account, you represent that you meet this requirement.

3.3 Account Security

You are responsible for all activity under your account. Notify us immediately at support@favorites.app if you suspect unauthorized access.

4. Subscriptions & Payments

4.1 Free & Paid Tiers

Favorites offers both free and paid subscription tiers. Paid subscriptions unlock additional features and higher usage limits.

4.2 Billing

Paid subscriptions are billed on a recurring basis (monthly or annually) through Stripe (web) or RevenueCat (mobile app stores). By subscribing, you authorize recurring charges at the then-current rate.

4.3 Cancellation

You may cancel your subscription at any time through your account settings or the relevant app store. Cancellation takes effect at the end of the current billing period. We do not provide prorated refunds for partial billing periods.

4.4 Wallet & Credits

The Service may include a wallet system for credits used on AI features. Wallet balances are non-refundable and non-transferable.

5. User Content

5.1 Ownership

You retain ownership of the content you create on the Service (items, lists, notes, comments). By posting content, you grant us a non-exclusive, worldwide license to host, display, and distribute that content as necessary to operate the Service.

5.2 Public Content

Content you mark as public (profiles, public lists) is visible to other users and may be indexed by search engines. You are responsible for what you choose to make public.

5.3 Content Standards

You agree not to post content that:

• Is unlawful, defamatory, obscene, or harassing
• Infringes on intellectual property rights of others
• Contains malware or harmful code
• Impersonates another person or entity
• Violates the privacy of others

6. AI Features

6.1 Recommendations

The Service offers AI-powered recommendations based on your saved items and rankings. These recommendations are generated by third-party AI models (Anthropic Claude) and are provided for informational purposes only. We do not guarantee the accuracy, completeness, or suitability of AI-generated suggestions.

6.2 AI Generation

AI-generated content (images, text) created through the Service is provided as-is. You are responsible for how you use AI-generated content and for ensuring it complies with applicable laws.

6.3 Data Usage

Item titles, rankings, and preference data may be sent to AI providers to generate recommendations. See our Privacy Policy for details.

7. Prohibited Uses

You agree not to:

• Use the Service for any illegal purpose
• Attempt to gain unauthorized access to the Service or other users' accounts
• Interfere with or disrupt the Service's infrastructure
• Scrape, crawl, or use automated means to access the Service without permission
• Use the Service to distribute spam or unsolicited messages
• Circumvent any usage limits, subscription restrictions, or access controls
• Reverse-engineer or decompile any part of the Service

8. Third-Party Services & Content

The Service integrates with third-party platforms for metadata enrichment, payments, and communications. We are not responsible for the content, policies, or practices of third-party services. Your use of linked third-party services is subject to their respective terms and privacy policies.

9. Termination

We may suspend or terminate your account at our discretion if you violate these Terms or engage in conduct that is harmful to other users or the Service. You may delete your account at any time through your account settings.

Upon termination, your right to use the Service ceases immediately. We may retain certain data as described in our Privacy Policy.

10. Disclaimers

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure. We disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Limitation of Liability

To the maximum extent permitted by law, Rhett Melton and Favorites shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service. Our total liability for any claims arising under these Terms shall not exceed the amount you paid us in the 12 months preceding the claim.

12. Indemnification

You agree to indemnify and hold harmless Rhett Melton and Favorites from any claims, damages, losses, or expenses (including reasonable attorney's fees) arising from your use of the Service, your content, or your violation of these Terms.

13. Governing Law

These Terms are governed by the laws of the United States. Any disputes arising from these Terms or the Service shall be resolved in accordance with applicable federal and state law.
